1. Under no circumstances will this cat be declawed before four months of age.
2. Under no circumstances will this cat be sold, leased or given to any pet shop, research laboratory or similar facility.
3. Adequate indoor, sanitary facilities will be provided and this cat will not be allowed to roam outdoors.
4. If this cat is found to be neglected or in ill health for an unreasonable length of time, purchaser will surrender said cat to seller unconditionally.
5. This cat has been vaccinated against panleukopenia, rhinotracheitis and calici virus on _____________________. Additional vaccinations are due on __________. Failure to provide all necessary vaccinations will render the Health Guarantee null and void. Other vaccinations given:____________________
6. HEALTH GUARANTEE: PURCHASER is receiving a healthy cat/kitten, free of internal and external parasites and all infectious disease or life-threatening congenital defects. PURCHASER must have his/her own veterinarian inspect said cat within three (3) working days of purchase and if any sign of illness is found, PURCHASER must contact BREEDER immediately, and may at PURCHASER’S option, either: 1) return said cat to BREEDER for full refund; or 2) return said cat to BREEDER for replacement cat/kitten if available; or 3) take cat to BREEDER’S choice of veterinarian for a second opinion, in which case BREEDER will pay all reasonable costs. If a veterinarian other than BREEDER’S choice institutes any treatment, this guarantee is null and void.
7. A one-year health guarantee will cover congenital defects or death due to natural cause. Replacement will be provided (no cash refunds are given after initial 3 working days) upon submission of a complete necropsy report including the results of blood work, tissue samples, etc. (a visual autopsy is not acceptable) with a signed veterinarian statement including a description of the symptoms to support the opinion. The PURCHASER will not be reimbursed for any expenses incurred while the cat was in the PURCHASER’S care. The one year guarantee does not cover conditions stemming from the PURCHASER’S neglect, illnesses or accidents the cat came in contact with while in the PURCHASER’S care, including blood transfusions, and death due to surgical procedures. This guarantee is for one year from date of purchase and applies only to the original PURCHASER. To qualify for the guarantee the PURCHASER must keep the cat under the regular care of a veterinarian and provide proof of annual vaccinations.
8. If PURCHASER qualifies for a replacement cat/kitten, a reasonable period of time (160 days or less) will be required. The replacement cat/kitten will be the same sex, and the BREEDER will attempt to match color, but can not guarantee the same color or age. Replacement of the same color may not be possible and could take slightly longer.
9. If purchased as a PET, PURCHASER agrees to neuter or spay this cat between the ages of eight months and one year after birth, or within thirty days after purchase if this is an adult cat, and agrees and guarantees that this cat will not be used for stud or breeding. BREEDER agrees to provide pedigree and registration papers on this cat upon presentation of a veterinarian’s certificate of neutering or spaying:
10. BREEDER does guarantee a kitten/cat sold for SHOWING or BREEDING will reproduce when of a sexually mature age. Some males and females may be two years old or slightly older before they produce off spring. If the sexually mature cat is not producing offspring PURCHASER will need to provide a signed veterinarian statement including a description of the symptoms to support the opinion.
11. If the cat has been purchased for breeding or showing, BREEDER will categorize its breeding quality and predict its show potential but NO GUARANTEES are provided with respect to show success.
12. Cat/kittens being sold for breeding are for the exclusive use in the PURCHASER’S breeding program. The PURCHASER agrees this cat/kitten will never be leased or sold to another cattery or individual, nor will it be sent to another cattery or individual for stud service or to be used at stud. The PURCHASER agrees that under NO CIRCUMSTANCE will this cat/kitten be placed with any other individual or cattery for the purpose of breeding. The PURCHASER agrees this cat/kitten will never be co-owned with anyone outside of the PURCHASER’S immediate household other than Rhamjoge Persians. Any situation in which this cat/kitten does not reside with the PURCHASER at their residence will be interpreted as a direct violation of this clause and the BREEDER is released from any and all guarantees and obligations of this contract. The PURCHASER however, is not released from complying with the other clauses contained in this contract including but not limited to payment of the full purchase price. Any monies previously paid to the BREEDER will not be refunded to the PURCHASER.
13. When the PURCHASER does not need this cat any longer, the BREEDER must be contacted. BREEDER has first option to receive the cat back. This cat can never be resold as a whole breeding cat. If the BREEDER chooses not to take this cat/kitten, the PURCHASER agrees the cat/kitten MUST BE SPAYED/NEUTERED before being placed in any other home or cattery for any reason. The BREEDER is not required to refund any monies. Any and all guarantees and responsibilities of the BREEDER related to health, including refunds and or replacement of this cat/kitten are strictly between the undersigned BREEDER and PURCHASER and are not to be considered transferable to any third party.
14. By signing this contract, BREEDER and PURCHASER are in full agreement with all of the above terms. In the event that the PURCHASER violates this agreement, the damages of $5,000 plus legal fees shall be payable to Rhonda Fox. Sole jurisdiction and venue for any legal dispute shall be in the State of Kansas, County of Johnson.
15. I have read the above, all of which I understand and accept.
16. This written agreement is the entire agreement between the PURCHASER and the BREEDER listed below. The PURCHASER will not rely on any verbal statements particularly about cash refunds or payments of veterinarian
